The Cost of Winning

"I was never ruined but twice; once when I lost a lawsuit and once when I won one."

Voltaire
18th century French writer/historian

How much more profitable might business be if there was a law banning lawsuits to settle disputes?

If those who would sue each other were forced to settle their differences without the use of lawyers.

  1. Easy to say, impossible to do. What happens when one side has power while the other side is right? Who looks out for the rights of both.

If you don't like lawyers just say so.

  2. I feel largely the same about lawyers as I do doctors. In my opinion their services cost too much due to the framework of their occupations, which has little if anything to do with them as individuals.

Why not some alternative system, one that might involve lawyers but no lawsuits, particularly if the incentive to prolong negotiation were removed?

Having been involved in a couple of legal scuffles during my business career, I well know how costly it can be, so much so that even a 10% to 30% reduction would be worth the effort.
